Future Conflict: The International Law of Cyber and Information Convergence

For some time now, the focus of discussions about international law’s role in regulating cyberspace has been almost exclusively on cyber effects—that is, operations targeting the functionality of information and communications technologies (ICT) or the confidentiality, availability or integrity of the data and information resident thereon. But as recent history demonstrates, the advent of cyberspace has also enabled and evolved the realm of information conflict, with an attendant and inevitable convergence of cyber and information operations. Whereas some states have long approached cyberspace through the broader lens of “information confrontation,” others are playing catch up to the threats posed by “cyber-enabled information operations” and assessing whether doctrinal barriers between cyber and information operations are artificial and should come down. The international law implications of this trend toward convergence are profound, implicating critical questions across the spectrum of war and peace, and hence the law of state responsibility, international human rights and humanitarian law.
